General Terms and Conditions (GTC)

for the online shop “www.marinamodest.de” – operated by Keles GbR

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through our online shop by consumers in Europe. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

As an authorized partner, Keles GbR distributes the products of the brands “Marina, Rimavera, Andalus” in Europe in its own name and on its own account.

3. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order. By clicking the "Buy now" button, you place a binding order for the goods in your shopping cart. Confirmation of receipt of your order will be sent by email immediately after you submit your order.

A purchase contract is concluded when we accept your order by sending an order confirmation via email or by delivering the goods.

4. Prices and shipping costs

All prices include VAT plus shipping costs. Shipping costs are displayed during the ordering process and depend on the country of delivery. For deliveries outside the EU, additional customs and import fees may apply, which are to be borne by the buyer.

5. Delivery

We ship within Europe. Delivery times are typically 3–7 business days within Germany and 5–10 business days within Europe.

If an item is unavailable, we will notify you immediately and reserve the right not to fulfill your order. Any payments already made will then be refunded.

6. Payment

7. Retention of title

The goods remain our property until full payment has been made.

8. Right of withdrawal

Consumers have a 14-day right of withdrawal. For details, please refer to our cancellation policy (see above).

9. Warranty

The statutory liability for defects applies. In the event of defects, you have the statutory right to subsequent performance (repair or replacement). If subsequent performance fails, you can demand a reduction in price or withdraw from the contract.

10. Liability

We are always liable without limitation for claims based on damages caused by us, our legal representatives or vicarious agents:

• in case of injury to life, body or health,
• in the event of intentional or grossly negligent breach of duty,
• insofar as the scope of application of the Product Liability Act is open.

In the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract, liability is limited to the foreseeable damage typical for the contract.

11. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12. Contract language, contract text storage

The contract language is German. We do not permanently store the contract text, but you will receive an order confirmation with all relevant information after completing your order.

Cancellation policy (for customers in Europe)

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period shall be 14 days from the day on which you or a third party designated by you received the goods.

To exercise your right of withdrawal, you must inform us (Keles GbR, Blumenstraße 18, 32839 Steinheim, Germany, email: kontakt@kelesgbr.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email).

You may use the attached sample cancellation form for this purpose, although this is not mandatory.

Consequences of revocation:

If you cancel this contract, we will reimburse you all payments that we have received from you (including delivery costs, with the exception of additional costs resulting from your choice of a type of delivery other than the standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we are informed about your decision to cancel this contract.

For this refund, we will use the same payment method you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees for this refund.

We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us immediately and in any event no later than 14 days from the date on which you notify us of the cancellation of this contract.

The deadline is met if you send the goods before the expiry of the 14-day period.

You shall bear the direct costs of returning the goods.
